MINOR WAIVER & CONSENT FORM

As consideration for the opportunity to bring the child or children, indicated below, (hereafter, collectively referred to as the “Child”) into the facility operated by Grand Rapids Voice Collective LLC, hereafter referred to as GRVC (Facility), I ACKNOWLEDGE AND PROMISE THAT I AM THE LEGAL GUARDIAN FOR EACH CHILD LISTED BELOW, AND THAT I WILL BRING NO OTHER CHILDREN INTO THE FACILITY OTHER THAN THOSE LISTED BELOW.

By signing this waiver, I assume the risks for the Child’s presence and participation within the Facility, waive all liability, and acknowledge receipt and agreement with GRVC policies and procedures (hereafter, this Wavier):
1. I ASSUME THE RISKS. I understand that the Facility is a vocal training center, and therefore, the Child’s participation in the services offered by GRVC subjects the Child to the possibility of physical injury (which could be minimal, serious, and/or result in death) and loss of or damage to my property, including, but not limited to, slips, falls, collision with equipment or others within the Facility, breathing issues, loss of air, loss of balance, or other bodily injury. Knowing these risks and reasonably anticipating that other injuries are a possibility, I hereby expressly assume all of the delineated risks of injury to the Child, myself, or others, all other possible risk of injury, and even risk of possible death, which could occur by reason of the Child’s presence within the Facility.
2. I WILL FOLLOW THE RULES. Further, I have notified of and agree to abide by all rules with respect to receiving services from
GRVC and having the Child present at the Facility, as well as any other GRVC policies and procedures. I further agree and warrant that if GRVC no longer wishes to offer access of the Facility to the Child, GRVC, in its sole discretion, can restrict such access.
3. PHOTO/VIDEO PERMISSION. If signed directly below this paragraph 3: I hereby grant GRVC the absolute right and permission to use the Child’s photographic portraits, pictures, digital images, or video recordings of the Child, or in which the Child may be included in whole or in part, or reproductions thereof, in color or otherwise, for any lawful purpose whatsoever, including but not limited to use in any GRVC publication, websites, without payment or any other consideration. I further hereby waive any right that I may have to inspect and/or approve the finished product or the copy that may be used in connection therewith, wherein the Child’s likeness appears, or the use to which it may be applied. By initialing directly below this paragraph 3, I am hereby giving full consent without reservation to
the foregoing paragraph 3.

4. I RELEASE GRVC. I hereby waiver, release, hold harmless, and forever discharge GRVC, its officers, directors, employees, agents, volunteers, and contractors (collectively, Releasees) from any present or future claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from the risks above (Claims), including those related to use of any equipment or items within the area designated as the Children’s area. I certify that I have adequate insurance to cover any injury or damage the Child may cause or suffer while present in the Facility, or else, as between each of the Releasees and me, I will be solely responsible for any and all medical and related bills that I, the Child, or a third party may incur because of any injury, as well as costs related to loss or damage to my property, that any party may sustain as a result of the Child’s presence in the Facility.
5. I WILL INDEMNIFY GRVC. Should GRVC or anyone acting on their behalf be required to defend themselves against any claim or demand or incur attorney’s fees and costs to enforce this Waiver, any other Waiver, the Private Lesson Agreement, or any other attending document, I agree to indemnify and hold them harmless for all such fees and costs, and pay actual attorney fees arising from such enforcement or defense.
6. THIS IS THE ENTIRE AGREEMENT AND IS BINDING. All waivers, the Private Lesson Agreement, and all attending
documents, contain the entire understanding between and among the parties concerning these matters. No waiver, modification, or amendment of any of the terms of this Waiver shall be effective unless made in writing and signed by the party to be charged. This Waiver shall be binding on my estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on my behalf or on behalf of my estate. I hereby expressly agree that if any portion of this Waiver is held invalid, the remainder of the Waiver shall nonetheless continue in full legal force and effect.
7. MICHIGAN LAW. I hereby expressly agree that (1) this Waiver shall be governed and construed according to the laws of the state of Michigan without regard to its conflict of laws provisions and (2) any action or proceeding concerning any Claim or the meaning or effect of any provision of the Waiver shall be conducted only in the federal or state courts located in the Western District of Michigan or Kent County, Michigan, and that for such purposes, I expressly submit to the jurisdiction of such courts.
